About us

This website is the online store of Yukoito, a series of NextCTR LLC, built on the Shopify platform. In the Terms of Service that follow, "we", "us" and "our" mean Yukoito. Visiting the site or buying from it means accepting these Terms along with our Privacy Policy, and anyone unwilling to accept them should not use the site or anything offered through it.

Eligibility and the details you provide

By using the site you confirm that you have reached the age of majority where you live. The details you hand over, from your email address to your billing, payment and delivery information, need to be accurate, current and complete. Placing an order also confirms that you are authorized to use the payment method you choose, and that its bank will honor what is charged. Anyone with an account keeps the login details for it private.

Products, prices and errors

Photographs and descriptions are prepared to represent color and detail honestly, and every display device renders color its own way, so what appears on your screen may not be an exact match for what arrives.

Our prices are subject to change without notice and, unless a page says otherwise, they leave out state and local sales tax.

We may limit the sale of any product, restrict sales to particular customers or regions, and discontinue or withdraw a product whenever we choose. A page here can carry a typo, an inaccuracy or an omission about a description, a price, availability or a promotion. Where we find one, correcting it, updating the page or canceling an affected order can all happen without notice.

Placing orders

An order is your offer to purchase, and we may accept it, limit it or refuse it for any reason. Preparation starts once checkout is complete, which is why an order can only be amended or stopped inside 2 hours of being placed. Beyond that, our Refund and Return Policy governs what happens.

Shipping, loss and damage

Delays created by a carrier, by weather or by anything else outside our control are not our liability, and any delivery date you are given is an estimate.

A parcel in transit remains our responsibility. Where it vanishes before it reaches you, or turns up harmed, email support@yukoito.com. Where an inquiry with the carrier confirms a loss or damage on the way, we send a replacement or a refund, as our Shipping Policy describes. Anything damaged or defective has to be reported inside 7 days of delivery, under our Refund and Return Policy.

Once the carrier records your parcel as Delivered at the address given at checkout, the risk of loss passes to you, and Yukoito carries no liability for a theft or a disappearance after that scan. Where a delivery fails because the address at checkout was incorrect or incomplete, the Shipping Policy explains what follows and a further attempt may carry a fee.

Our content and your feedback

The text, photographs, graphics, logos, layout and other material on this site belong to Yukoito or to those who license it to us, and copyright and other intellectual property laws protect all of it. Nobody may copy, reproduce, resell or otherwise exploit any part of it without our written permission.

Send us a suggestion, an idea or a review and we may use, edit, copy and publish it in any medium, without restriction, without payment to you and with no duty to keep it confidential.

Using the site, and links to other sites

Use the site lawfully. Nobody may use it, or anything on it, to: (a) infringe intellectual property rights, ours or anyone else's; (b) spread false or misleading information; (c) transmit malicious code; (d) collect personal information about other visitors; or (e) interfere with the site or with anyone else's use of it.

Some links lead to third party websites that Yukoito neither controls nor monitors, and we are not liable for what those sites contain or for any loss connected to what is obtained through them.

Shopify and your data

Shopify supplies the platform and hosts the store, yet each sale is an agreement between you and Yukoito alone; Shopify is not a party to it and is not responsible for claims about what you buy here. Our Privacy Policy explains how personal information collected through the store is handled, and Shopify processes information of its own in order to run the platform. Using the site means you understand that.

Disclaimers and limitation of liability

The site and the services on it are provided "as is" and "as available", without a warranty that they will run without interruption, without error or entirely securely. That disclaimer covers the site and its services and does not apply to the products you buy: nothing here cuts down the rights consumer protection law gives you, including implied warranties that cannot lawfully be excluded, and the remedies for a damaged, defective or incorrect delivery are in the Refund and Return Policy.

So far as the law allows, and leaving aside liability that cannot be limited, neither Yukoito nor its directors, officers, employees or suppliers is liable for indirect or consequential loss, or for incidental or special damages, arising from use of the site or its services.

You agree to indemnify, defend and hold harmless Yukoito and NextCTR LLC, together with their officers, directors, employees, agents, contractors, partners and affiliates, from third party claims and demands, including reasonable attorneys' fees, that arise from your breach of these Terms, from a law you have broken, or from someone else's rights that you have infringed.

Disputes and arbitration

This part changes the way a dispute between you and Yukoito is handled, so please read it closely. A claim or dispute connected with these Terms, or with anything bought from Yukoito, goes to binding arbitration on an individual basis instead of to a court, administered by the American Arbitration Association (AAA) under its own rules. You and Yukoito each give up the right to have a jury hear the dispute, and neither of us may start or join a class action, a classwide arbitration or any other representative case.

The laws of the State of Texas govern these Terms and every other service agreement between you and us.

Severability and changes to these Terms

Should a court or an arbitrator hold any provision of these Terms unlawful, void or unenforceable, that provision is narrowed or struck out only to the extent needed, and everything else here stays in force.

We may amend these Terms whenever we need to by publishing the amended version on this page, so a look at it now and then is worthwhile. Continued use of the site after an amendment appears means you accept it.
